The Uniform Code of Military Justice (UCMJ) stipulates different levels of seriousness of infractions:

  • Administrative separation, involuntary discharge from service for misconduct
  • Nonjudicial punishment, decided by commanding officers for minor offenses
  • Summary court-martial, in which one commissioned officer may try enlisted personnel for noncapital offenses
  • Special court-martial, sometimes characterized as a misdemeanor court, consisting at least three members and a military judge
  • General court-martial, generally considered to be the felony court, consisting of at least five members and a military judge. The accused may request trial by a military judge alone.
  • A general court-martial, often characterized as the felony court

Of these, the general court-martial is the most serious. Before a defendant can be referred to a general court-martial, however, an Article 32 hearing must be held to determine whether sufficient evidence exists to pursue a general court-martial.
